Terms of Use and SMS Terms

These Terms of Use and SMS Terms (“Terms”) govern access to and use of aurhomesgroup.com and the features, content, property-search tools, forms, communications, and services available through the website (collectively, the “Site”).

The Site is operated by Aurhomes Group LLC, using the real-estate and messaging brand “Aurhomes Group” (“Aurhomes,” “we,” “us,” or “our”). Aurhomes Group is brokered by eXp Realty. The eXp Realty name and marks belong to their respective owner and are used only as authorized.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Website Information Only; Separate Real-Estate Agreements

The Site provides general information and tools relating to real estate. Using the Site, searching listings, submitting a form, creating an account, or communicating with Aurhomes does not by itself create a broker-client relationship, agency relationship, fiduciary relationship, representation agreement, or obligation to represent you.

Any brokerage representation or other real-estate service relationship must be established through the separate disclosures and written agreements required by applicable law. If these Terms conflict with a signed real-estate agreement covering the same subject, the signed agreement controls to the extent of the conflict.

2. Consumers, Buyers, Sellers, Landlords, and Tenants

The Site may be used by prospective or current buyers, sellers, landlords, tenants, property owners, and other consumers to search for information, request property details, ask questions, arrange appointments or showings, and learn about real-estate services.

You are responsible for providing accurate contact and request information. Submitting a request does not guarantee that a property remains available, that a showing can be scheduled, that an offer will be accepted, or that any transaction will close.

3. Listings and Property Information

Property listings, prices, availability, dimensions, square footage, school information, taxes, fees, market statistics, photographs, descriptions, maps, and other property information may come from multiple listing services, property owners, brokers, vendors, public records, or other third parties.

Real-estate information can change rapidly and may contain errors, omissions, delays, or inaccuracies. Information on the Site is not a representation or warranty about a property and must be independently verified before reliance or a decision. Properties may be withdrawn, sold, leased, repriced, or otherwise changed without notice.

Nothing on the Site is an appraisal, inspection, survey, title report, environmental report, legal description, financing commitment, or guarantee of property condition or value.

4. No Professional Advice

Site content is general information and is not legal, tax, accounting, insurance, lending, appraisal, engineering, inspection, environmental, or other specialized professional advice. Consult an appropriately licensed professional regarding your circumstances.

Mortgage calculators, estimated payments, affordability figures, market estimates, and similar tools are illustrative only. They are not loan offers, underwriting decisions, credit decisions, or commitments to lend.

5. Fair Housing and Equal Opportunity

Aurhomes supports equal housing opportunity and conducts real-estate activities in accordance with applicable federal, state, and local fair-housing laws. We do not discriminate based on race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by applicable law. Requests for reasonable accommodations or modifications may be submitted through the contact page.

6. Accounts and Submitted Information

Some Site features may allow you to create an account, save searches, request alerts, or submit information. You agree to provide accurate information and, if credentials are issued, to protect them from unauthorized use. Notify us through the contact page if you believe an account or credential has been compromised.

Information you submit will be handled as described in the Privacy Policy and SMS Privacy Policy.

7. Acceptable Use

You may use the Site only for lawful personal or legitimate business purposes related to evaluating or obtaining real-estate information or services. You may not violate applicable law or another person’s rights; submit false, misleading, defamatory, discriminatory, infringing, or unlawful material; impersonate another person; attempt unauthorized access; introduce malicious software; interfere with Site operations; harvest or systematically extract Site content or personal information without authorization; send spam; or use Site content or data to facilitate housing discrimination or another unlawful purpose.

We may restrict access or remove submitted material when reasonably necessary to protect the Site, users, rights holders, or legal compliance.

8. Intellectual Property

The Site and its original text, design, graphics, logos, photographs, video, software, and other content are owned by Aurhomes or used with permission from licensors, listing services, vendors, agents, property owners, or other rights holders. They are protected by copyright, trademark, and other laws.

You may view and make a reasonable personal copy of Site content for noncommercial real-estate evaluation. No other license is granted. Site content may not be reproduced, republished, distributed, modified, sold, framed, or commercially exploited without permission from the applicable rights holder.

9. Third-Party Services, Vendors, and Links

The Site may use or link to services operated by third parties, including property-search platforms, multiple listing services, mapping providers, scheduling tools, analytics providers, social networks, mortgage or financial tools, telecommunications providers, and other vendors.

Third-party services are controlled by their operators and may have separate terms and privacy policies. A link or integration does not necessarily mean Aurhomes endorses or guarantees the third party, its content, or its services. Review the third party’s terms before using its service.

10. Privacy

The Privacy Policy and SMS Privacy Policy explain how personal information is handled and describe applicable privacy choices. A third party collecting information directly through an embedded or linked service may also apply its own policy.

11. SMS Messaging Program

People who expressly opt in may receive text messages from Aurhomes Group. Depending on the consent provided, messages may include responses to real-estate inquiries; requested property information and listing updates; appointment, consultation, showing, or open-house coordination; transaction-related or customer-service communications; and marketing messages about real-estate services, listings, and opportunities when separately consented to.

By entering your mobile number and affirmatively checking an applicable unchecked consent box, you authorize Aurhomes Group to send only the categories of text messages stated in that disclosure to the number provided, including through automated technology where applicable. Consent to receive marketing texts is not a condition of purchasing any property, goods, or services. You represent that you are the subscriber or customary user of the number and are authorized to consent.

Message frequency varies based on requests, activity, and preferences. Message and data rates may apply.

Reply STOP to any Aurhomes Group text message to opt out. We may send one non-promotional message confirming the opt-out. We will honor other reasonable revocation requests as required by applicable law.

Mobile telephone numbers, text-message originator opt-in data, and SMS consent information are not sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. We may provide such information to vendors acting solely on our behalf to operate and support the messaging program, subject to restrictions, or disclose it when required by law.

Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on the carrier and is not guaranteed.

12. Electronic Communications

When you submit a form, request information, or contact us electronically, you consent to receive responses through the channels you requested or otherwise lawfully authorized. Marketing consent is governed by the separate disclosure presented at enrollment and may be withdrawn as described above.

13. Site Availability and Changes

We may update, suspend, restrict, or discontinue Site features when reasonably necessary. The Site may be unavailable because of maintenance, technical problems, vendor outages, events beyond our control, or other causes. We do not promise uninterrupted or error-free access.

14. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” AURHOMES DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT THOSE WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SITE OR CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, UNINTERRUPTED, OR ERROR-FREE. THESE DISCLAIMERS DO NOT LIMIT RESPONSIBILITIES THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW OR OBLIGATIONS EXPRESSLY CREATED BY A SIGNED REAL-ESTATE AGREEMENT.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AURHOMES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF OR INABILITY TO USE THE SITE, RELIANCE ON SITE CONTENT, OR THIRD-PARTY SERVICES.

THIS SECTION DOES NOT EXCLUDE LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY ARISING FROM FRAUD, WILLFUL MISCONDUCT, OR OTHER NON-WAIVABLE RIGHTS. IT DOES NOT ALTER DUTIES OR REMEDIES UNDER A SEPARATE SIGNED REAL-ESTATE AGREEMENT.

16. Changes to These Terms

We may update these Terms by posting a revised version with a new effective date. Changes do not retroactively expand the scope of previously granted SMS or marketing consent. Material changes affecting an existing contractual relationship will be handled as required by applicable law and any signed agreement.
